AGREEMENT TO OUR TERMS
Welcome to Australian Standard Typing Tests™ ("Company", "we", "our", or "us"), a company registered in Australia. These Terms and Conditions ("Terms") govern the operation of the website www.australianstandardtypingtests.com.au, as well as any other related products and services that refer or link to these Terms (collectively, the "Services"). These Legal Terms constitute a legally binding agreement between you and Australian Standard Typing Tests concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree, you are prohibited from using the Services and must discontinue use immediately.
These Legal Terms do not affect your rights as a consumer under Australian Consumer Law (ACL) or any other applicable Australian legislation.
We reserve the right to make changes to these Legal Terms at any time. We will alert you of any changes by updating the Last Updated date. It is your responsibility to review these Legal Terms periodically.
The Services are intended for users who are at least 18 years of age. Persons under 18 are not permitted to use or register for the Services.

1. OUR SERVICES
Australian Standard Typing Tests™ provides fully automated and accredited online typing test certificates that meet Australian Typing Standards and Regulations (AS2708-2001). We use technology from Typequick to deliver the Typing Skill Evaluator tests, ensuring compliance with the AS2708-2001 Keyboarding Skills Standard.
Our Services are intended for use by working-age adults for professional and employment-related purposes. All personal information collected in connection with the Services is used solely to administer and verify your typing assessment and to maintain your account. We do not use your information for commercial purposes. For full details, please refer to our Privacy Policy.
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution would be contrary to law. Those who choose to access the Services from locations outside Australia do so on their own initiative and are responsible for compliance with local laws.
2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property
We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, and certificate designs (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
Our Content and Marks are protected by copyright and trademark laws in Australia and international treaties.
We grant you a non-exclusive, non-transferable, revocable licence to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.
No part of the Services, Content, or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission.
Reviews and Feedback
From time to time, you may choose to submit feedback, suggestions, or reviews about the Services. By doing so, you grant us a non-exclusive, royalty-free licence to use that feedback to improve our Services. We will not use your feedback for advertising or commercial purposes beyond improving and operating the Services, consistent with our Privacy Policy.
You retain ownership of any feedback or reviews you submit. We do not claim any intellectual property rights in respect of feedback or reviews beyond the limited licence described above.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
All registration information you submit is true, accurate, current, and complete.
You will maintain the accuracy of such information and promptly update it as necessary.
You have the legal capacity and agree to comply with these Legal Terms.
You are at least 18 years of age.
You will not access the Services through automated or non-human means.
You will not use the Services for any illegal or unauthorised purpose.
Your use of the Services will not violate any applicable Australian law or regulation.
You will be the individual personally completing the typing tests and will not engage in any form of cheating or dishonest practices.
You understand that providing a certificate completed by another individual to an employer or other third party may constitute fraud under Australian law.
4. USER REGISTRATION
You may be required to register to use the Services. You agree to keep your credentials confidential and are responsible for all use of your account. We reserve the right to remove, reclaim, or change a username if we determine it is inappropriate, offensive, or otherwise objectionable.
5. PRODUCTS
All products are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.
6. PURCHASES AND PAYMENT
Accepted Payment Methods: We accept Stripe (Mastercard, Visa, Apple Pay, Google Pay) and PayPal.
Currency and Tax: All prices are in Australian Dollars (AUD). GST will be added to the price of purchases as required under Australian law.
Payment Processing: Payment transactions are processed directly by Stripe and PayPal. We do not store payment card information in our own systems.
Authorisation: By providing payment information, you represent that you are authorised to use the designated payment method and authorise us to charge the total amount of your purchase.
Pricing Corrections: We reserve the right to correct any errors in pricing.
7. REFUND POLICY AND CONSUMER GUARANTEES
At Australian Standard Typing Tests, we are committed to customer satisfaction.
Refund Requests: We consider reasonable partial or full refund requests on a case-by-case basis. To request a refund, please contact us at info@australianstandardtypingtests.com.au within 14 days of your purchase.
Digital Products: Due to the digital nature of our products, refunds may not be available once access has been granted and the test has been completed.
Australian Consumer Law Guarantees: Nothing in these Legal Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified. If the ACL applies to a supply of our Services, and we fail to comply with a consumer guarantee under the ACL, your remedies are governed by the ACL. Our liability for such failure is limited, to the extent permitted by law, to resupplying the Services or paying the cost of resupply.
8. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to:
Trick, defraud, or mislead us or other users, particularly in any attempt to learn sensitive account information.
Circumvent, disable, or otherwise interfere with security-related features of the Services.
Use any information obtained from the Services to harass, abuse, or harm another person.
Make improper use of our support services or submit false reports.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Upload or transmit viruses or any other malicious code that will or may be used in any way that will affect the functionality or operation of the Services.
Engage in any automated use of the system, such as using scripts to send comments or messages.
Delete the copyright or other proprietary rights notices from any Content.
Impersonate another user or person, or use the username of another user.
Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services.
Copy or adapt the Services' software or reverse engineer any of the software comprising the Services.
Allow any other person to use your account to complete typing tests on your behalf.
Engage in any form of cheating, including but not limited to using software, automation, or third-party assistance to complete tests.
Use the Services to advertise or offer to sell goods and services.
Systematically retrieve data or content from the Services to create or compile a database or directory without written permission.
9. REVIEWS AND FEEDBACK
You may have the opportunity to post reviews or submit feedback about our Services. When posting a review, you agree to:
Only submit reviews based on firsthand experience with the Services.
Not include offensive, discriminatory, or abusive language.
Not post false or misleading statements.
Not include references to illegal activity.
Not organise campaigns encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews at our sole discretion. Reviews do not represent our views and we are not responsible for their content.
10. THIRD-PARTY WEBSITES AND CONTENT
The Services may contain links to third-party websites and may display content from third parties. Such websites and content are not monitored or checked by us, and we are not responsible for any third-party websites accessed through the Services or any third-party content posted on or available through the Services.
11. SERVICES MANAGEMENT
We reserve the right to:
Monitor the Services for violations of these Legal Terms.
Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms.
Refuse, restrict access to, limit the availability of, or disable any of your contributions or any portion thereof.
Remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.
Otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.
12. PRIVACY POLICY AND DATA USE
We care about data privacy and security. Your personal information is collected and used solely to administer and verify your typing assessment and maintain your account. We do not use your personal information for commercial purposes and we do not sell your personal information to any third party.

By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.
13. COPYRIGHT INFRINGEMENTS
If you believe that any material available on or through the Services infringes upon any copyright you own or control, please notify us immediately at info@australianstandardtypingtests.com.au with details of the alleged infringement. We will investigate all valid notices and take appropriate action.
14. TERM AND TERMINATION
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to terminate your use of or participation in the Services, or delete your account, without warning, in our sole discretion, particularly where there has been a breach of these Legal Terms, fraudulent conduct, or cheating.
Upon termination, your right to use the Services will immediately cease. Termination does not affect any rights or obligations that arose prior to termination.
15. MODIFICATIONS AND INTERRUPTIONS
Service Changes: We reserve the right to change, modify, or remove the contents of the Services at any time for any reason without notice.
Availability: We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems requiring maintenance, resulting in interruptions, delays, or errors.
No Liability for Interruptions: We shall not be liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance, subject to our obligations under the ACL.
16. GOVERNING LAW
These Legal Terms are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts in Queensland, Australia.
Nothing in these Legal Terms limits any rights you may have as a consumer under the Australian Consumer Law or any other mandatory Australian consumer protection legislation.
17. DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, you agree to first attempt to negotiate any dispute informally by contacting us at info@australianstandardtypingtests.com.au. We will endeavour to respond within 30 days.
Australian Consumer Law Disputes
For consumer disputes, you may also contact the Australian Competition and Consumer Commission (ACCC) or your relevant state or territory consumer protection agency for assistance and guidance.
Payment Platform Disputes
For disputes specifically relating to payment transactions, the dispute resolution processes of PayPal and Stripe remain available to you.
Exceptions
The above informal negotiation process does not apply to disputes seeking to enforce or protect intellectual property rights, claims for injunctive relief, or allegations of theft or piracy.
18. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time without prior notice. This does not affect the validity of any certificate already issued.
19. DISCLAIMER
The Services are provided on an AS IS and AS AVAILABLE basis, subject to your rights under the Australian Consumer Law. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no warranties or representations about the accuracy or completeness of the Services' content. Nothing in this disclaimer excludes any consumer guarantees applicable under the ACL.
20. LIMITATIONS OF LIABILITY
To the fullest extent permitted by applicable Australian law:
Indirect Damages: We will not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including loss of profits.
Maximum Liability: Our liability to you for any cause of action will be limited to the amount paid by you to us in the six (6) months prior to any cause of action arising.
21. INDEMNIFICATION
You agree to indemnify and hold harmless Australian Standard Typing Tests and its officers, directors, employees, and agents from any loss, damage, liability, claim, or demand (including reasonable legal fees) arising out of your use of the Services, your breach of these Legal Terms, or your violation of the rights of any third party, to the extent permitted by applicable Australian law.
22. ELECTRONIC COMMUNICATIONS
By using the Services, you consent to receive electronic communications from us in accordance with Australian law. You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
23. MISCELLANEOUS
Entire Agreement: These Legal Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services.
Severability: If any provision of these Legal Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Waiver: Our failure to enforce any right or provision will not operate as a waiver of such right or provision.
No Assignment: You may not assign your rights under these Legal Terms without our prior written consent.
